GST Returns for Late Submission: Businesses in Bangladesh registered for GST are required to file their GST returns and pay the GST arrears (if any) within one month of the end of the accounting year covered by the GST return. Even if the company’s GST registration is NIL, it must be filed despite the lack of business activity during the accounting period.
The NBR takes filings seriously, and action will be taken against businesses that do not file GST returns on time or fail to file at all.

What Sort of Action Would NBR Take For Late Submission of GST Returns

If a business fails to file their GST return within the time limit, the NBR can take the following steps:
1. Issue an arrest warrant
2. Imposing a late deposit penalty
3. The person responsible for running the business will be summoned to court.
4. An Estimated Notice of Assessment (NOA) may be issued in addition to the penalty of 5% late payment on the estimated tax.
5. Upon receipt of an NOA, it is mandatory for businesses to file their GST returns immediately and declare the actual amount of GST liability. This must be done to correct the NOA.
6. Businesses or sole proprietors are at risk of being sued if they fail to file their GST returns online, and / or pay a late deposit penalty by the due date. Businesses still have to file their outstanding GST returns, and failing to do so could lead to further legal action against them.
7. If the traders do not attend the court hearing, pay the summons at least one week before the court date, or if they do not file their GST return on time, there is a risk of an arrest warrant being issued.
